Ohio's rules
Ohio doesn't have a single statute that tells private businesses how to dispose of paper records; the federal rules — HIPAA, GLBA, and the FACTA Disposal Rule — do the heavy lifting. Two Ohio laws matter on top of them. Ohio's breach-notification law (R.C. 1349.19) requires businesses to notify residents when their personal information is exposed, and paper found in a dumpster counts. And the Ohio Data Protection Act (R.C. 1354) gives businesses a legal safe harbor against data-breach lawsuits if they follow a recognized security framework — and documented, secure disposal of records is part of every one of those frameworks.
